On 14 March 2025, the Crimes (Theft by Employer) Amendment Act 2025 became part of the Crimes Act 1961 (Section 220AA, Theft by Employer).

Withholding an employee’s pay without a reasonable excuse can make the employer (and potentially a payroll practitioner) criminally liable. If this is found to have happened, individuals could face up to one year in prison and/or a $5,000 fine. All other employers could face a fine of up to $30,000.

In this special webinar, we will discuss this new amendment to the Crimes Act 1961 and provide examples of what payroll needs to do to ensure employees’ wages are not unlawfully withheld. We will also cover how payroll practitioners can ensure any advice to hold employee wages is based on sound legislative requirements.
