Query – ACC Employee Payments

Question:

 

Please assist with a query regarding ACC payments.

 

The employer obligation ceases after the first week for work related accidents, and ACC pays from the second week onwards (80% of lost earnings).

 

1)      I have been asked whether there is a cut off point at which ACC ceases to make payments to an injured employee, or can a claim go on indefinitely?

 

2)      Are their instances where the injured person has their own insurance yet still makes a claim with the ACC?  Is it possible for somebody to be paid by both?

 

Answer:

 

To answer your first question, ACC will continue to pay a client will they have an incapacity and are meeting their criteria, attending rehabilitation and attending medical assessments required.

 

In saying that, if a person has been on ACC for 2 years or longer when they reach 65 years of age then weekly comp will cease and the client would then go onto Superannuation.

 

Question 2, Yes a person can have private income protection Insurance and receive weekly compensation. That person would need to also speak with their Insurer to let them know they’re on ACC incase it affects their policy.
